1. Introduction

These Terms and Conditions (“Terms”) govern your interactions with Fylde Transport Trust CIO (“Fylde Transport Trust”, “the Trust”, “we”, “us”, or “our”), a Charitable Incorporated Organisation registered in England and Wales (Charity Number: 1197287).

By making a donation, purchasing images, booking or attending a fundraising event, visiting our premises, or boarding any Trust-operated heritage vehicle, you agree to be bound by these Terms.

If you do not agree with these Terms, you should not engage in Trust activities or transactions.

2. About the Trust

Fylde Transport Trust exists to preserve, restore, operate, and exhibit historic public transport vehicles, and to educate the public about the heritage of public transport through events, displays, and charitable activities.

3. Definitions

“Donor” means any individual or organisation making a monetary or in-kind donation.

“Visitor” means any person attending a Trust premises or event.

“Event” means any fundraising, educational, or public-facing activity organised or supported by the Trust.

“Heritage Vehicle” means any historic bus, tram, or other vehicle owned, operated, or displayed by the Trust.

4. Donations and Fundraising Event Bookings
4.1 Donations

Donations to Fylde Transport Trust may be made in the following ways:

Online via Stripe, our third-party payment processor; or

Directly to the Trust (for example, by bank transfer or cheque) where a donor prefers not to use Stripe.

When making a donation via Stripe, your payment details and associated data are processed and stored by Stripe in accordance with their own terms and privacy policies. The Trust does not store full card details.

All donations are voluntary and non-refundable unless required by law.

4.2 Fundraising Event Bookings

Bookings for fundraising or ticketed events are managed using Bókun, a third-party booking platform.

By booking an event, you acknowledge that:

Booking and attendance data is collected, processed, and stored by Bókun in accordance with their terms and privacy policies; and

The Trust accesses booking information solely for event administration, safeguarding, and legal compliance.

Event availability is subject to capacity and operational considerations.

5. Boarding and Use of Heritage Vehicles
5.1 General Caution

Heritage vehicles are historic in nature and may not meet modern vehicle design standards. Passengers and visitors must exercise reasonable care at all times.

5.2 Boarding and Alighting

When boarding or alighting from heritage vehicles, you must:

Take care when using steps, handrails, and doorways, which may be steeper or narrower than modern vehicles;

Follow all instructions given by Trust staff or volunteers;

Supervise children and vulnerable individuals at all times.

5.3 Accessibility

While the Trust aims to make activities as inclusive as possible, some heritage vehicles may have limited accessibility. Visitors should contact the Trust in advance to discuss specific mobility requirements.

5.4 Personal Responsibility

You board and travel on heritage vehicles at your own risk, subject to the Trust’s duty of care under applicable law.

6. Health and Safety

6.1 Trust premises, workshops, and events may involve moving vehicles, tools, uneven surfaces, and other inherent risks.
6.2 Visitors must comply with all signage, safety barriers, and instructions issued by Trust representatives.
6.3 The Trust reserves the right to refuse access to any area or activity on safety grounds.

7. Photography, Images, and Intellectual Property
7.1 Trust Intellectual Property

All photographs, images, logos, branding, written content, and media created by or for the Trust remain the intellectual property of Fylde Transport Trust unless explicitly stated otherwise.

7.2 Purchase and Use of Images

Where the Trust offers images for sale:

Purchase grants the buyer a non-exclusive licence to use the image for private or commercial purposes;

Ownership and copyright remain with Fylde Transport Trust.

7.3 Restrictions on Resale and Redistribution

Purchased images must not be resold, sublicensed, redistributed, or made available to third parties, whether for profit or otherwise, without the Trust’s prior written consent. This restriction applies even after lawful purchase.

7.4 Unauthorised Use

Unauthorised reproduction, resale, or misuse of Trust images or intellectual property may result in legal action.

8. Privacy and Data Protection

The Trust processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and applicable data protection laws.

Personal data is used only for legitimate charitable purposes, including donations, event management, safeguarding, and legal compliance. Further details are available in the Trust’s Privacy Policy.

9. Liability

9.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or any liability that cannot be excluded under English law.
9.2 Subject to the above, the Trust’s liability for any loss, damage, or claim is limited to the amount paid by you for the relevant event, image, or transaction.

10. Cancellations and Refunds

10.1 Event cancellation and refund terms will be communicated at the time of booking.
10.2 Donations are non-refundable except where required by law.
10.3 The Trust reserves the right to cancel events due to circumstances beyond its reasonable control.

11. Amendments to These Terms

The Trust may update these Terms from time to time. Revised Terms will be published on our website, and continued engagement with the Trust constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
